On March 6, 2025, Belgian freelance photojournalist Simon Clément was arrested at Lengpui Airport in Aizawl, Mizoram, after two empty bullet cartridges were discovered in his luggage during a routine security check. Clément, who had recently returned from Myanmar, claimed the spent casings were souvenirs from his time documenting conflict zones in Chin State.
Authorities charged Clément under Section 25(1-B) of the Indian Arms Act, 1959, for possession of ammunition, and Section 14 of the Foreigners Act, 1946, for allegedly crossing into Myanmar without valid documentation. He was initially held in police custody before being remanded to judicial custody at Tanhril Jail on March 8.
On March 19, Clément was granted bail by the Aizawl Chief Judicial Magistrate upon furnishing a bond of ₹50,000. As part of his bail conditions, he is prohibited from leaving Mizoram and must report to the investigating officer when summoned. His legal counsel, Reuben L. Tochhawng, expressed confidence in a swift acquittal, arguing that the case against Clément is weak, as the cartridges were empty and intended as keepsakes.
The Mizoram Journalists’ Association (MJA) has voiced concern over Clément’s arrest. MJA President C. Lalrambuatsaiha stated that representatives of the organization would meet Clément to offer support.
Clément’s case highlights the legal complexities journalists may face when operating in sensitive regions. His experience underscores the importance of understanding and adhering to local laws, especially concerning border crossings and possession of items that may be considered contraband.
