A British High Court judge has ruled in favour of journalist Owen Jones in a significant stage of a libel case brought against him by a senior BBC editor, marking an important development in a legal dispute linked to coverage of the war in Gaza.
The case was filed by Raffi Berg, the BBC’s online Middle East editor, who sued Jones over a 2024 article discussing the broadcaster’s internal tensions regarding its reporting on Israel’s war in Gaza. In the article, Jones cited accounts from BBC staff and argued that Berg played a role in shaping coverage in a way that critics believed favoured Israeli narratives. Berg rejected the allegations and claimed the piece damaged his professional reputation.
During preliminary proceedings, the High Court ruled that the article should be interpreted as an expression of opinion rather than a statement of fact. This distinction is significant in UK defamation law because opinions can be protected under the legal defence known as “honest opinion,” provided they are based on identifiable material. The judge determined that Jones’ argument was presented as commentary supported by referenced sources rather than as a factual claim about Berg’s conduct.
The ruling represents a key legal victory for Jones at this stage of the case, as it shifts the legal framework under which the dispute will proceed. Instead of requiring Jones to prove the factual accuracy of the allegations, the decision means the claim must now address whether the opinion expressed in the article was honestly held and grounded in available evidence.
Jones welcomed the decision, stating that he stood by his reporting and that the ruling affirmed his right to publish critical commentary on matters of public interest. He indicated he would continue to defend the article if the case moves forward to a full trial.
Berg has not withdrawn the claim, and legal proceedings could continue depending on the next steps in the court process.
