Lawyers who defend journalists face increasing harassment and legal attacks globally, raising serious concerns about press freedom and the rule of law. A recent study by the American Bar Association’s Center for Human Rights, Media Defence, and the Thomson Reuters Foundation documented over 40 cases in 10 countries—including Turkey, Russia, China, and Guatemala—where lawyers have been targeted for representing journalists or defending media freedoms.
These legal professionals often encounter criminal charges such as terrorism, corruption, or spreading “false news” soon after taking on cases related to journalists. Such accusations can lead to arrests, heavy fines, suspension or revocation of legal licenses, and long-term detention. In many instances, these actions are accompanied by violations of due process, including arbitrary detention and denial of access to evidence.
Beyond direct legal charges, lawyers face systematic obstacles in their work. They may be denied access to case files, prevented from meeting privately with detained clients, or disqualified from cases on questionable grounds. These tactics serve to weaken journalists’ legal defenses and deter other lawyers from taking on similar cases, effectively limiting the ability of journalists to obtain fair representation.
The targeting of lawyers defending journalists is part of a broader effort by some governments to suppress dissent and control information. By intimidating legal defenders, authorities aim to silence critical voices and erode the protections that enable free expression. This trend endangers not only individual lawyers but also the broader principles of democracy and justice.
International human rights organizations warn that urgent action is needed to protect these lawyers. Strengthening legal safeguards, providing international support, and raising awareness about their plight are crucial steps to ensure lawyers can continue their essential role. These defenders are vital for maintaining media freedom and holding power to account, making their protection a key priority in the global fight for human rights.
